Terms of Service - Road2Sky

1. Acceptance of Terms

By accessing or using the Road2Sky platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Road2Sky operates a premium ground-transportation platform connecting passengers ("Riders") with independent, vetted transportation providers ("Chauffeurs"). Road2Sky does not provide transportation services directly and acts solely as a technology platform facilitating the connection.

3. User Accounts

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must provide accurate and complete information during registration.
You may not create multiple accounts or share your account with others.
We may suspend or terminate accounts that violate these terms.

4. Rider Terms

Riders may request rides through the platform subject to chauffeur availability.
Fare estimates are shown before booking; final fares are calculated upon completion.
Cancellation fees may apply — see our cancellation schedule in the FAQ.
Riders must treat chauffeurs and their vehicles with respect. Damage or misconduct may incur charges.

5. Chauffeur Terms

Chauffeurs are independent contractors, not employees of Road2Sky.
Chauffeurs must maintain a valid driver's licence, commercial auto insurance, and vehicle registration.
Chauffeurs must pass our background check and vehicle inspection before accepting rides.
Chauffeurs must comply with all applicable federal, state, and local laws at all times.

6. Payments

All payments are processed securely through Stripe or Square, using PCI-DSS compliant tokenisation.
Fares include base fare, distance charge, time charge, applicable surcharges, and taxes.
Tips are optional and go entirely to the chauffeur.
Refunds are issued per our refund policy — contact support for eligibility.

7. Prohibited Conduct

Users may not:

Use the Service for illegal purposes, including transporting contraband or fleeing authorities.
Harass, threaten, or discriminate against other users based on any protected characteristic.
Tamper with, reverse-engineer, or scrape the platform.
Create false accounts, impersonate others, or engage in any form of fraud.

8. Limitation of Liability

Road2Sky is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Service. Our total aggregate liability is limited to the amount paid by you in the preceding twelve (12) months, or $100 USD — whichever is greater.

9. Service Area

Road2Sky currently operates in Atlanta, Georgia. We are actively preparing service launches in New York City, NY and Newark, NJ. We do not accept bookings outside these areas. Where TNC, livery, or for-hire vehicle licensing is required by state or municipal law, all our drivers and vehicles operate under the appropriate permits.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict-of-laws principles. Any disputes shall first be resolved through good-faith negotiation. If unresolved, the parties agree to submit to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration seated in Fulton County, Georgia. Where mandatory consumer-protection law of a user's home state (e.g. New York General Business Law, New Jersey Consumer Fraud Act, the New Jersey Data Privacy Act, or the New York SHIELD Act) provides stronger rights, that law controls to the extent required.

Nothing in these Terms waives any non-waivable rights you may have under federal consumer-protection law (Federal Trade Commission Act, Telephone Consumer Protection Act, Americans with Disabilities Act) or applicable state law.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be announced via email or platform notification with at least 14 days' notice. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
